A SEM-based approach using likelihood-based confidence interval has been proposed to form confidence intervals for unstandardized and standardized indirect effect in mediation models. However, when used with the maximum likelihood estimation, this approach requires that the variables are multivariate normally distributed. This can affect the LBCIs of unstandardized and standardized effect differently. In the present study, the robustness of this approach when the predictor is not normally distributed but the error terms are conditionally normal, which does not violate the distributional (...) assumption of ordinary least squares estimation, is compared to four other approaches: nonparametric bootstrapping, two variants of LBCI, LBCI assuming the predictor is fixed and LBCI based on ADF estimation, and Monte Carlo. A simulation study was conducted using a simple mediation model and a serial mediation model, manipulating the distribution of the predictor. The Monte Carlo method performed worst among the methods. LBCI and LBCI-Fixed-X had suboptimal performance when the distributions had high kurtosis and the population indirect effects were medium to large. In some conditions, the problem was severe even when the sample size was large. LBCI-ADF and nonparametric bootstrapping had coverage probabilities close to the nominal value in nearly all conditions, although the coverage probabilities were still suboptimal for the serial mediation model when the sample size was small with respect to the model. Implications of these findings in the context of this special case of nonnormal data were discussed. (shrink)

This paper analyzes Russian-French philosopher Alexandre Kojève’s dialogue with proponents of Hegelianism and phenomenology in Soviet Russia of the 1920–30s. Considering works by Dmytro Chyzhevsky, Ivan Ilyin, Gustav Shpet, and Alexandre Koyré, I retrace Hegelian themes in Kojève, focusing on the relation between method and time. I argue that original reflections on method played a key role in both Russian Hegelianism and Kojève’s work, from his famous Hegel lectures to the late fragments of a system. As I demonstrate, Kojève’s (...) Hegelianism was significantly shaped by his encounter with Ilyin’s 1918 commentary on Hegel, a detailed study of the relation between method and the experience of time. However, in Kojève’s hands, Ilyin’s ideas were transformed, some radicalized, others abandoned. Comparatively reading texts by these thinkers in their respective contexts, I resituate and evaluate claims that Hegel’s method was less dialectical than phenomenological. I finally argue that early Soviet Hegelian discourses not only shaped the trajectory of Kojève’s Hegelianism but also radically anticipated concepts of time in French post-structuralism. (shrink)

Empirical discussions of mental representation appeal to a wide variety of representational kinds. Some of these kinds, such as the sentential representations underlying language use and the pictorial representations of visual imagery, are thoroughly familiar to philosophers. Others have received almost no philosophical attention at all. Included in this latter category are analogue magnitude representations, which enable a wide range of organisms to primitively represent spatial, temporal, numerical, and related magnitudes. Philosophy, scientific psychology, and common sense all distinguish perception from cognition. While there is little agreement about how the perception–cognition boundary ought to be drawn, one prominent idea is that perceptual states are dependent on a stimulus, or stimulus-dependent, in a way that cognitive states are not. This paper seeks to develop this idea in a way that can accommodate two apparent counterexamples: hallucinations, which are prima facie perceptual yet stimulus-independent; and demonstrative thoughts, which are prima facie cognitive yet stimulus-dependent. Aristotle is often thought of as one of the fathers of essentialism in Western philosophy. Aristotle’s argument for the essence of human beings is, however, much more flexible than this prejudice might suggest. In the passage about the “human function” at Nichomachean Ethics 1.7, Aristotle gives an account of the particular “function” (or “achievement,” ergon) of human beings that does not ask very much of the modern reader—only that she be prepared to analyze human beings as a logical category according (...) to certain rules. While this may trouble the naturalistic reductionist or the post-humanist thinker, it is not clear that Aristotle’s request is unreasonable, especially given what the function argument goes on to offer. It places normative thinking in the constellation of type-property-activity, a narrowing of the search for the human good, but not an overly constrictive one. The second, substantive stage of the argument gives a more narrow interpretation of what the unique property and its corresponding activity are in the case of humans—but even here Aristotle’s apparently “thick” conclusions about the ultimate human good ultimately leave more room for a pluralistic disagreement about ends than might be expected. This article argues that we can improve the way we teach early modern political philosophy if we introduce students to alternative views about the development of the state. First, it summarizes the work of contemporary philosophers and historians who are critical of the modern state. Second, it points out ways in which early social contract theorists take the state for granted. Third, it argues that alternative views about the development of the state can help students take a more critical perspective (...) on standard works of early modern political philosophy. Drawing on the empirical premise that attention makes objects look more intense, Ned Block has argued for mental paint, a phenomenal residue that cannot be reduced to what is perceived or represented. If sound, Block's argument would undermine direct realism and representationism, two widely held views about the nature of conscious perception. We argue that Block's argument fails because the empirical premise it is based upon is false. Attending to an object alters its salience, but not its perceived intensity. We (...) also argue that salience should be equated with mental primer, a close cousin of mental paint that reintroduces difficulties for direct realism and representationism. The upshot is that direct realism and representationism are still in trouble, but not for the reason that Block thinks. (shrink)

In an age of constitutional revolutions and reforms, theory and practice are moving in opposite directions. As a matter of constitutional practice, human dignity has emerged in jurisdictions around the world as the organizing idea of a groundbreaking paradigm. By reconfiguring constitutional norms, institutional structures and legal doctrines, this paradigm transforms human dignity from a mere moral claim into a legal norm that persons have standing to vindicate. As a matter of constitutional theory, however, human dignity remains an enigmatic idea. (...) Some explicate its meaning in abstraction from constitutional practice, while others confine themselves to less exalted ideas. The result is a chasm that separates constitutional practice from a theory capable of justifying its innovations and guiding its operation. John Morrison has argued that confidences are assigned in perceptual experience. For example, when you perceive a figure in the distance, your experience might assign a 55-percent confidence to the figure’s being Isaac. Morrison’s argument leans on the phenomenon of ‘completely trusting your experience’. I argue that Morrison presupposes a problematic ‘importation model’ of this familiar phenomenon, and propose a very different way of thinking about it. While the article’s official topic is whether confidences are assigned in perceptual experience, it (...) is also about two more general issues: how we can determine which properties are assigned in perceptual experience; and how we transition from perception to belief. Recent theological anthropology emphasizes a dynamic and integral understanding of the human being, which is also related to Karl Rahner's idea of active self-transcendence and to the imago Dei doctrine. The recent neuroscientific discovery of the “visual word form area” for reading, regarded in light of the concept of cultural neural reuse, will produce fresh implications for the interrelation of brain biology and human culture. The theological and neuroscientific parts are shown in their mutual connections thus articulating the notion that (...) human beings shape and transcend themselves both at the biological and at the cultural level. This will have relevant implications for the timely topic of human uniqueness in science and theology, and in proposing a new research perspective in which theology may consider culture along with its biological import, but not necessarily in strictly evolutionary terms alone. Identifying, classifying, and analyzing arguments in legal discourse has been a prominent area of research since the inception of the argument mining field. However, there has been a major discrepancy between the way natural language processing (NLP) researchers model and annotate arguments in court decisions and the way legal experts understand and analyze legal argumentation. While computational approaches typically simplify arguments into generic premises and claims, arguments in legal research usually exhibit a rich typology that is important for gaining insights (...) into the particular case and applications of law in general. We address this problem and make several substantial contributions to move the field forward. First, we design a new annotation scheme for legal arguments in proceedings of the European Court of Human Rights (ECHR) that is deeply rooted in the theory and practice of legal argumentation research. Second, we compile and annotate a large corpus of 373 court decisions (2.3M tokens and 15k annotated argument spans). Finally, we train an argument mining model that outperforms state-of-the-art models in the legal NLP domain and provide a thorough expert-based evaluation. Recent findings have provided evidence for the existence of non‐vertebrate acquired immunity. We survey these findings and propose that all living organisms must express both innate and acquired immunity. This is opposed to the paradigm that only vertebrates manifest the two forms of immune mechanism; other species are thought to use innate immunity alone. We suggest new definitions of innate and acquired immunity, based on whether immune recognition molecules are encoded in the inherited genome or are generated through somatic processes. (...) We reason that both forms of immunity are similarly ancient, and have co‐evolved in response to lifestyle, cost‐benefit tradeoffs and symbiosis versus parasitism. However, different species have evolved different immune solutions that are not necessarily genetically related, but serve a similar general function – allowing individuals to learn from their own immune experience; survival of species is contingent on the acquired immune experience of its individuals. How do we come to like the things that we do? Each one of us starts from a relatively similar state at birth, yet we end up with vastly different sets of aesthetic preferences. These preferences go on to define us both as individuals and as members of our cultures. Therefore, it is important to understand how aesthetic preferences form over our lifetimes. This poses a challenging problem: to understand this process, one must account for the many factors at play (...) in the formation of aesthetic values and how these factors influence each other over time. A general framework based on basic neuroscientific principles that can also account for this process is needed. Here, we present such a framework and illustrate it through a model that accounts for the trajectories of aesthetic values over time. Our framework is inspired by meta-analytic data of neuroimaging studies of aesthetic appraisal. This framework incorporates effects of sensory inputs, rewards, and motivational states. Crucially, each one of these effects is probabilistic. We model their interactions under a reinforcement-learning circuitry. Simulations of this model and mathematical analysis of the framework lead to three main findings. First, different people may develop distinct weighing of aesthetic variables because of individual variability in motivation. Second, individuals from different cultures and environments may develop different aesthetic values because of unique sensory inputs and social rewards. Third, because learning is stochastic stemming from probabilistic sensory inputs, motivations, and rewards, aesthetic values vary in time. These three theoretical findings account for different lines of empirical research. Through our study, we hope to provide a general and unifying framework for understanding the various aspects involved in the formation of aesthetic values over time. (shrink)

Kant's political philosophy draws a distinction between 'passive' citizens who are merely protected by the law and 'active' citizens who may also contribute to it. Although the distinction between passive and active citizens is often dismissed by scholars as an 'illiberal and undemocratic' relic of eighteenth century prejudice, the distinction is found in every democracy that distinguishes between mere inhabitants -- such as tourists and guestworkers -- and enfranchised citizens. The purpose of this essay is both interpretive and suggestive. First, (...) I will argue that Kant's mature distinction between active and passive citizens follows from an institutional deficiency in the the developing state rather than the natural deficiency of passive citizens, as Kant's critics have alleged. Second, I will draw on systematic features of Kant's political thought in order to claim that the state has a duty to create the institutional conditions of universal active citizenship. (shrink)

It is argued that claims about personal obligation (of the form "s ought to 0") cannot be reduced to claims about impersonal obligation (of the form "it ought to be the case that p"). The most common attempts at such a reduction are shown to have unacceptable implications in cases involving a plurality of agents. It is then argued that similar problems will face any attempt to reduce personal obligation to impersonal obligation.

We use this editorial essay as a call for a more effective use of new technologies, such as mobile apps and Web 2.0 tools, to educate students and other relevant stakeholders on business ethics, corporate social responsibility, and sustainability topics. We identify three overarching reasons that justify the need for new ways of teaching that further incorporate technology to foster the innovative thinking needed to tackle imminent societal grand challenges such as climate change and increasing inequality. First, we are facing (...) a new generation of millennials and Generation Z students who are digital natives and more likely to search for educational content on their electronic devices. Second, new technologies offer opportunities to reach students globally, helping to democratize education. Third, we posit that the intrinsic characteristics of societal grand challenges, which are complex, uncertain, and evaluative, can benefit from technology as an effective translator of multilayered concepts into more digestible action items. Our essay ends with a brief summary of the four essays included in the thematic symposium: “There is an App for that! The Use of New Technologies and Apps in Ethics, Corporate Social Responsibility and Sustainability Education.”. (shrink)

Agamben’s notion of the ‘paradigm’ has far-reaching implications for educational thinking, curriculum design and pedagogical conduct. In his approach, examples—or paradigms—deeply engage our powers of analogy, enabling us to discern previously unseen affinities among singular objects by stepping outside established systems of classification. In this way we come to envision novel groupings, new patterns of connection—that nonetheless do not simply reassemble those singular objects into yet another rigidly fixed set or class. Agamben sees this sort of ‘paradigmatic understanding’ as our (...) richest source of intelligibility. For Agamben the paradigm is ultimately about learning to see again, starting not with already perfectly known and categorized objects (or ideas), but rather with a fresh experience of one individual object and the analogical relations it may have to others, and to novel groupings that may arise. The paradigm is a method, a way in which educators might respond to a wide range of educational challenges. For a paradigmatic relation suspends while exposing, deactivates while revealing, complicates while clarifying. But articulating the enigmatic paradigmatic relation between example and class is far more than a method. It is epistemological (a way of knowing and conception of knowledge), ethical (a fostering of freedom from presupposed categories and reified principles) and ontological (a type of being that exposes the potential of knowing and communicating—their intelligibility and communicability). In these qualities, paradigms exhibit to educators a free, a new use of singularities. (shrink)
